Commission agreement

The rules, in writing.

These terms govern every commission. They are confirmed in the ticket before any payment, and accepting a quote means accepting them.

01Parties and scope

↑
  1. “Artist” means Trumpão, the author of the artwork. “Client” means the person or company commissioning it. “Commission” means the artwork described in the accepted quote.

  2. These terms apply to every commission, worldwide, unless a separate written agreement signed by both parties says otherwise.

02How the contract is formed

↑
  1. A conversation is not a contract. The contract exists when the Client accepts a written quote that states scope, price, number of revisions and delivery estimate.

  2. Quotes are valid for 7 days. After that the Artist may re-quote.

  3. The Artist may decline any commission, at any point before work starts, for any reason. If a commission is declined, everything already paid is returned in full.

03Price, currency and taxes

↑
  1. Prices published on this site are starting prices. The final price is the one in the accepted quote.

  2. Brazilian clients are quoted in BRL and pay by PIX. International clients are quoted in USD and pay by PayPal invoice. Roblox projects may be paid in Robux by gamepass, at the rate agreed in the ticket.

  3. Payment processor fees are included in the quoted price. Any tax, duty or bank charge levied in the Client's own country is the Client's responsibility. Taxes owed in Brazil are the Artist's responsibility.

  4. Robux payments account for the platform's 30% cut: the gamepass price is set so the agreed amount is what actually arrives.

04Payment schedule

↑
  1. The Client chooses: 50% before the work enters the queue and 50% before final delivery, or 100% upfront.

  2. Work enters the queue only after the first payment is confirmed by the Artist. Clicking “I have paid” requests verification; it does not by itself confirm payment.

  3. Watermarked previews are shared during the process. Final files without watermark are released after the full payment is confirmed.

  4. The Artist never asks for card numbers, security codes, bank passwords or any banking credential, and never stores them. Anyone asking for those in the Artist's name is not the Artist.

05Timeline and delivery

↑
  1. The delivery estimate counts from the moment the queue reaches the commission, not from the moment of payment. The Client is told their queue position.

  2. Estimates are estimates. If a deadline is contractual, it must be stated in the quote and it changes the price.

  3. Delivery is made through the Discord ticket, in the formats listed in the quote. The Artist keeps delivered files available for 12 months; after that, re-delivery may be charged.

  4. If the Client does not respond for 7 days at a stage that needs their approval, the commission goes on hold and the slot is released to the next in queue.

06Revisions and scope changes

↑
  1. Two rounds of revision are included, unless the quote says otherwise.

  2. A revision is an adjustment inside the approved sketch: colour, lighting, detail, framing. Changing the concept, the character, the composition or the subject after the sketch is approved is a new scope, quoted separately.

  3. Extra revision rounds are charged at 20% of the commission price each, agreed before they are done.

07Intellectual property

↑
  1. On confirmation of full payment, the Artist grants the Client a worldwide, perpetual, non-exclusive licence to use the commissioned artwork commercially: in the game, on store pages, in advertising, on social media and in promotional material.

  2. Until payment is confirmed in full, no licence exists and no use is authorised.

    Yes, this includes previews.

  3. Exclusivity — meaning the Artist may not licence the same artwork to anyone else — is available, must be written into the quote, and costs extra.

  4. The Client may not resell or redistribute the artwork as a standalone asset, sublicense it outside their own project, or register it as a trademark without separate written agreement.

  5. Working files (layered source) are not included unless the quote says so.

  6. Under Brazilian law the Artist's moral rights — authorship and integrity of the work — are personal, inalienable and cannot be waived, in any country, whatever the licence. Credit is appreciated but not required, except where the quote says it is.

    Lei 9.610/1998, arts. 24 and 27.

08Portfolio and embargo

↑
  1. The Artist keeps the right to show the commissioned work in portfolio, social media and promotional material, identifying the Client's project.

  2. If the project is unannounced, say so in the ticket. The Artist will hold the artwork private until the launch date, or for an agreed embargo period.

  3. The Client may ask for a piece to be removed from the portfolio at any time, and the Artist will remove it.

09What the Client guarantees

↑
  1. The Client confirms that every reference, character, logo, text or asset they send is theirs to use, or is free to use, and does not infringe anyone's rights.

  2. If a third party makes a claim because of material the Client supplied, the Client is responsible for it and will hold the Artist harmless.

  3. The Artist will not copy another artist's specific work or imitate a named living artist's personal style.

10Artificial intelligence

↑
  1. The artwork is drawn by hand by the Artist. Generative image models are not used to produce the delivered work.

  2. The Client may not use the artwork, in whole or in part, as training data for any machine learning or generative model, nor allow a third party to do so.

11Confidentiality

↑
  1. Anything the Client shares about an unreleased project stays confidential. The Artist will not discuss it publicly before the Client announces it.

  2. This obligation survives the end of the commission.

12Cancellation and refunds

↑
  1. Before any work has started: full refund.

  2. After the sketch stage has started but before it is approved: refund of everything except the deposit, which covers the work already done.

  3. After the sketch is approved: no refund of the deposit. Any amount paid beyond the deposit is returned.

  4. If the Artist cancels for any reason other than a breach by the Client, everything paid is returned in full.

  5. Refunds go back through the same method used to pay, within 10 business days of the decision.

13Consumer rights

↑
  1. If the Client is a consumer, consumer protection law prevails over any clause here that gives them less. Nothing in these terms removes a right the law gives.

  2. Brazil: consumers who buy at a distance have a 7-day right of regret under the Consumer Protection Code. It is exercised through the ticket, and the Artist processes it.

    CDC, Lei 8.078/1990, art. 49.

  3. European Union and United Kingdom: consumers normally have 14 days to withdraw from a distance contract. That right does not apply to goods made to the consumer's specifications or clearly personalised — which is what a commission is. The cancellation clause above applies instead, and it is more generous than the legal minimum in the early stages.

    Directive 2011/83/EU, art. 16(c).

14Chargebacks

↑
  1. If there is a problem, open it in the ticket first. A chargeback opened without contact is treated as non-payment: the licence in clause 07 is revoked and use of the artwork becomes unauthorised.

15Limitation of liability

↑
  1. The Artist's total liability for any claim arising from a commission is limited to the amount the Client paid for that commission, except where the law does not allow such a limit — including fraud, wilful misconduct and consumer rights.

  2. The Artist is not liable for the commercial performance of the Client's project. A thumbnail is a tool, not a promise of clicks, sales or visits.

16Force majeure

↑
  1. Neither side is in breach for delay caused by events outside reasonable control — illness, power or internet failure, natural disaster, platform outage. The affected side tells the other as soon as possible and the deadline moves accordingly.

17Personal data

↑
  1. The Artist processes only what is needed to do the work and keep commercial records. The full detail, and how to request deletion, is on the privacy page.

  2. Brazilian clients are covered by the LGPD. Clients in the European Union and United Kingdom are covered by the GDPR, including the right of access, correction, deletion and portability.

    Lei 13.709/2018; Regulation (EU) 2016/679.

18Governing law and jurisdiction

↑
  1. These terms are governed by Brazilian law.

  2. Disputes go to the courts of the Artist's domicile in Brazil. A consumer may always sue in the courts of their own domicile, and this clause does not remove that.

    CDC, art. 101, I.

  3. Before going to court, both sides agree to try to resolve it in the ticket first.

19Changes to these terms

↑
  1. The Artist may update these terms. The version that applies to a commission is the one published when the quote was accepted, and it does not change afterwards.

  2. If a clause turns out to be invalid, the rest stays in force.

Accepting a quote means accepting these terms. Unsure about any clause? Ask in the ticket before you pay.
